Terms of Service

These Terms of Service (“Terms”) form a binding agreement between you and Avori (“Avori,” “we,” “us,” or “our”). By creating an account, submitting photos, or otherwise using our services (the “Service”), you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 18 years old to use the Service. By using Avori, you represent that you meet this age requirement and that you have the legal capacity to enter into these Terms. If you are using the Service on behalf of someone else, you represent that you are authorized to do so.

Avori provides a personalized facial assessment and transformation report based on photos you upload and information you provide. The report covers your hair, skin, color palette, facial features, and a structured 30-day action plan. Reports are informational and aesthetic in nature. They are not medical advice, not a diagnosis, and not a substitute for consultation with a qualified medical or aesthetic professional.

We may add, remove, or change features of the Service at any time. Where a change materially reduces the value of a paid report you have already purchased, we will notify you by email.

You are responsible for keeping your account credentials secure and for all activity that occurs under your account. Notify us immediately at hello@tryavori.com if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms or that we reasonably believe are being misused.

When you upload a photo or submit questionnaire responses (collectively, “User Content”), you confirm that:

• You are the person depicted, or you have the explicit consent of every identifiable person in the content.
• You have all rights necessary to submit the content to us.
• The content does not violate any law or any third party’s rights.

You retain ownership of your User Content. By submitting it, you grant Avori a worldwide, non-exclusive, royalty-free license to process, store, transmit, and display that content solely as needed to deliver the Service to you, to operate and improve our analysis methodology, and to comply with our legal obligations. We do not sell your photos or share them with advertisers.

You may request deletion of your photos and personal information at any time by emailing hello@tryavori.com. See our Privacy Policy for details on how we handle your data.

Your report is generated using a combination of proprietary analysis methods, computer vision techniques, and clinical reference frameworks. By using the Service, you acknowledge and consent that your photos and questionnaire responses will be processed by automated systems and reviewed by our internal team to produce your report and to improve service quality. Named third-party processors (Google Gemini, Anthropic Claude, OpenAI) are listed in the Privacy Policy.

Biometric data consent (BIPA / GDPR Article 9). The analysis derives biometric measurements (facial landmark coordinates) and infers attributes (skin tone, hair texture, facial proportions, descriptive ethnicity context) from your photos. Under the Illinois Biometric Information Privacy Act and Article 9 of the EU General Data Protection Regulation, this is biometric and special-category data and requires your separate, explicit, opt-in consent. You give that consent on the photo-upload screen by checking the dedicated biometric consent box (recorded with timestamp + version). You can withdraw consent and have the derivations deleted by deleting your account from the Settings page.

Automated outputs may contain errors. We work to minimize them, but you should review any recommendation before acting on it, and you should always confirm clinical or treatment decisions with a qualified provider.

Avori is not a healthcare provider. Reports are aesthetic guidance, not medical diagnoses, prescriptions, or treatment plans. Recommendations involving products, procedures, supplements, or lifestyle changes are educational. Before starting any treatment, taking any product, or making any significant change to your routine, consult a licensed physician, dermatologist, or other qualified professional. If you have a medical emergency, contact emergency services immediately.

The Service is offered as one-time paid reports. Pricing, features, and any add-ons are shown at checkout. All charges are processed by our payment processor (currently Stripe). Sales tax may apply.

30-Day Satisfaction Guarantee. If your report does not change how you approach your hair, skin, or style, contact us within 30 days of receiving it for a full refund. Contact hello@tryavori.com to request a refund. Refunds are issued to the original payment method within 10 business days of approval.

You agree not to:

• Submit photos of any person without their explicit consent.
• Submit photos of minors.
• Reverse engineer, scrape, or attempt to extract our analysis methodology.
• Use the Service to harass, defame, or harm any person.
• Resell, redistribute, or commercially exploit any report or its contents without our written permission.
• Interfere with the Service’s operation, security, or integrity.
• Use automated tools to access the Service except as we expressly permit.

The Service, including reports, prompts, models, methodology, designs, software, and content (other than your User Content), is owned by Avori and protected by intellectual property laws. We grant you a limited, personal, non-transferable license to view and use your report for your own personal, non-commercial purposes.

We use third-party processors to operate the Service, including payment processing (Stripe), hosting, analytics, and automated analysis services. These processors are bound by their own terms and privacy obligations and operate under written processing agreements with us. They are not authorized to use your data for any purpose other than delivering the Service to you.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED. WE DO NOT WARRANT THE ACCURACY OR COMPLETENESS OF ANY REPORT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AVORI WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO AVORI IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

You agree to indemnify and hold harmless Avori, its officers, employees, and agents from any claim, loss, or demand (including reasonable attorneys’ fees) arising out of your User Content, your use of the Service, or your violation of these Terms.

You may delete your account at any time by emailing hello@tryavori.com. We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or for any other reason in our reasonable discretion. Sections that by their nature should survive termination (including ownership, disclaimers, limitations of liability, and dispute resolution) will survive.

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts. Where a dispute can be resolved through good-faith negotiation, you agree to attempt that first by emailing hello@tryavori.com.

We may update these Terms from time to time. The “Last updated” date at the top of this page reflects the most recent revision. Material changes will be communicated by email or via a prominent notice in the Service. Continuing to use the Service after changes take effect constitutes acceptance.
